Compliance and enforcement

The Department of Transport and Major Infrastructure (DTMI) aims to provide and enable safe, accessible and efficient movement within Western Australia, and administers various Acts and legislation to achieve this goal.

The below Education and Enforcement Policy helps communicate how DTMI assesses and enforces compliance, reflecting our commitment to education as the primary tool to achieve voluntary compliance.

DTMI's regulations apply to the delivery of various transport modes including private and commercial vehicle, taxis and other passenger transport vehicles, recreational and commercial vessels and coastal facilities and jetties.

Maritime Compliance and Enforcement Collection Notice

An inspector or authorised person designated under s.117 of the Western Australian Marine Act 1982 may use, collect and disclose personal information for compliance and enforcement purposes under the WA Marine Act 1982, Criminal Procedure Act 2004, Marine and Harbours Act 1981, Pollution of Waters by Oil and Noxious Substances Act 1987 and other applicable laws. Law enforcement purposes may include, but are not limited to, verifying your identity, conducting compliance checks, investigating complaints, incidents or alleged offences, issuing infringements, cautions or notices and collecting or preparing evidence for criminal proceedings.

Failing to provide information when an inspector or authorised person is exercising a power under legislation compelling you to provide it can constitute an offence. Providing false information to an inspector or authorised person may also constitute an offence. DTMI may disclose your information to law enforcement agencies, interstate or overseas licensing authorities, courts or other entities as permitted by law, including for identity verification and law enforcement purposes.
